今回のご説明と、ご紹介する著作権のご使用ルールは編み物を楽しむどなたでもご利用いただけるガイドラインとなりますが、表記内容自体にも著作権が発生しておりますので、こちらのガイドラインを手引きとして引用なさりたい場合は、文章の流用ではなく、ページリンクを貼ってこちらのページに誘導なさるようにしてください。文章自体の流用や改変、無断転載は硬くお断りいたします。

１ はじめに
皆様、いつもSusanna's Hobbies®をご覧いただきありがとうございます。
この度、Susanna's Hobbiesの動画に関する著作権侵害をYouTubeに申告した経緯についてご説明いたします。
２ Susanna's Hobbies®の動画を含む出版物全般（作品を含む）についての著作物性
Susanna's Hobbies®の動画には，Susanna's Hobbies®が文献，作品等の資料の原典を調査・分析し，これを基に，Susanna's Hobbies®がその成果として，編み方を創作し，発表しているものが含まれております。調査・分析の対象となる原典には，日本国外のものや日本語以外の言語により，表記又は表現されているものも含まれております。また，原典における表記又は表現に含まれていない不足部分がある場合等，原典のみでは編み方が判然とせず，最終的な編み方を判明するまでに，必要に応じて当該不足部分にあたる編み方を見つけ出すなど，創造的な埋めこみ作業についても行い，編み方として発表しているものもあります。
編み目や編み方に関する表現の著作物性についての裁判例において，編み方そのものについては，その著作物性を否定したものもありますが，他の裁判例において「自然科学上の法則やその発見及びこれを利用した発明等についても、これを叙述する叙述方法について創作性があり、その論理過程等を創作的に表現したものであつて、それが学術、美術等の範囲に属するものについては、その内容とは別に、右表現された表現形式が著作物として、著作者人格権・著作財産権の保護の対象となり得る」とされ，少なくとも創作的な表現形式（説明方法）については，著作者人格権、著作財産権保護の対象となることを認めております。
従いまして，Susanna's Hobbies®が発表した編み方に関し，YouTube上で発表したものを含み，その表現形式（説明方法）については，Susanna's Hobbies®に著作権が帰属するものです。また，原典の翻訳を行い発表したものについては，翻訳にかかる部分について，二次的著作物として，Susanna's Hobbies®に著作権があります。
そして，Susanna's Hobbies®の発表した編み方の動画を含めた発表内容については，上述のような日本語以外の言語からの翻訳である点，原典における表記又は表現に含まれていない不足部分がある場合には，必要に応じてこれを創造的に埋めた部分である点，そもそも，資料の調査段階で国内の文献等には記載がなく，日本国内で未発表であったことがわかるものである点など，複数の観点から，それがSusanna's Hobbies®の表現であることを特定することを特定することができるものが含まれております。
３ 著作権侵害について
今般，表現形式や翻訳部分について，Susanna's Hobbies®の発表したものであると特定できる表現部分をそのまま出所の明示もなく，配信されている動画（以下，「侵害動画」といいます。）が複数，確認されました。これらの動画のうち，表現形式や翻訳部分について，Susanna's Hobbies®の発表したものであると特定できる部分について，少なくとも時系列において送信開始時点がSusanna's Hobbies®の動画配信時点より遅れるものについては， Susanna's Hobbies®の著作権を侵害するものであると考えております。
このためSusanna's Hobbies®としては，当該侵害動画の配信者に対し，当該動画が，Susanna's Hobbies®の著作権を侵害するものであることから，今般，YouTubeに著作権を侵害する旨，申告をさせていただきました。
４ 利用許諾の範囲について
自然科学上の法則やその発見及び右法則を利用した技術的思想の創作である発明等（以下，「法則等」といいます。）は、万人にとつて共通した真理であって、それが特許権等の対象となる場合は別として，何人に対してもその自由な利用が許さるべきです。
今般，改めて，Susanna's Hobbies®としても，編み方と著作権法との関係について弁理士及び弁護士に対して問い合わせ，利用許諾を求めることができる範囲について，確認を行いました。
そして，Susanna's Hobbies®として，上記法則等については，全ての編み物をする方々が自由に利用できるようであって欲しいと考えるに至りました。この点において，これまで利用許諾を求めてきた範囲について，以下のとおり改めさせていただきます。なお，今回，Susanna's Hobbies®としては，表現形式や翻訳部分に関する著作権侵害を問題としており，編み目，編み方についての著作権を主張するものではありません。
・Susanna's Hobbies®の作品および出版物全般：著作権の対象となりますので，利用許諾をこれまでどおり申請してください。
・Susanna's Hobbies®の表現形式（説明方法）：動画や出版物で，出所の明示として，Susanna's Hobbies®を引用元として記載等してください。
・Susanna's Hobbies®の発表した編み目，編み方のみ：利用許諾の対象としません。ただし、編み目、編み方を動画や出版物でSusanna's Hobbies®の表現を用いて説明する場合は、Susanna's Hobbies®を引用元として記載等してください。
・Susanna's Hobbies®が契約上利用許諾対象と明示した，又は，特許権等を有する編み目，編み方：利用許諾を申請してください。
なお，今般，Susanna's Hobbies®が YouTubeに申告した動画の中には，編み方について，著作権を有すると主張し，当該編み方による制作物についての販売に際して，許可を要求し，営利的に利用するものも含まれておりました。これについては，編み目，編み方について，本来であれば自由に利用できるものであるところを，不当に独占し，利益を得ようとするものであると考えます。このような状況については，今なおSusanna's Hobbies®の動画や出版物の不正な利用が看過し難い事態に陥っているものと考えております。
５ 今後について
Susanna's Hobbies®としては，侵害動画の配信者に対し，追って，代理人を通じて侵害動画の差し止めを通知する予定でおりますが，この場をもって改めて，自主的に侵害動画の配信を停止するよう申し入れます。
また，侵害動画において主張する著作権がないことを明らかにし，当該動画において不当な利益を得ることをやめるよう申し入れます。
なお，侵害動画において，Susanna's Hobbies®に著作権のある翻訳部分及び説明部分の表現をそのまま利用し続ける場合，引用部分を明確にするとともに元としてSusanna's Hobbies®のクレジット等を明記し，引用として正当な方法で行っていただくよう申し入れます。

Susanna's Hobbies®としては，今後も，世界各国の文献などを調査，研究し，編み物が好きである方々に届けて参りたいと考えております。そして，より良い編み物の世界の発展と貢献に貢献したいと考えております。

2 Copyrights for all publications in general (including works of art), including Susanna's Hobbies® videos
Susanna's Hobbies® videos include material in which Susanna's Hobbies® has researched and analyzed the original sources of literature, artwork and other materials, and on the basis of which Susanna's Hobbies® has created and presented crochet and knitting techniques as the result of such research and analysis. The following is a list of the products that are included in the report. The sources studied and analyzed include those outside of Japan and those written or expressed in languages other than Japanese. In addition, there are cases where there are missing parts in the source texts that are not included in the notation or expressions, and where the crochet or knitting method is not clear from the source texts alone, and the crochet or knitting method that corresponds to such missing parts may need to be changed as necessary before the final crochet or knitting method is determined. Some of them are also creative embedding, such as finding a knitting method, and presenting it as a crochet and knitting method.
In some court decisions on the copyrightability of expressions regarding crochet and knitting stitches and knitting techniques, the copyrightability of the crochet and knitting techniques themselves has been denied. However, other court decisions have held that "even with regard to the laws of natural science, their discoveries, and inventions that make use of them, if there is creativity in the descriptive method used to describe them, and if the logical process, etc., is expressed in a creative manner, and if it falls within the scope of science or art, etc., then the above expression, apart from its content, is not a work of authorship. The form of expression may be subject to protection of moral rights and copyright property rights as a work of authorship". In other words, it is recognized that at least the creative form of expression (method of explanation) is subject to protection of moral rights and copyright property rights.
Therefore, with regard to the crochet and knitting instructions published by Susanna's Hobbies®, including those published on YouTube, the form of expression (method of explanation) is copyrighted by Susanna's Hobbies®. Susanna's Hobbies® owns the copyright to the translation of the original source material as a derivative work.
With respect to the contents of Susanna's Hobbies® presentations, including all of the videos on crochet and knitting, the copyright is owned by Susanna's Hobbies® in that they are translations from languages other than Japanese as described above, and that if there are any missing parts not included in the notation or expressions in the original source, Susanna's Hobbies® has creatively made them available to the public, if necessary. The material includes items that can be identified as being an expression of Susanna's Hobbies® from multiple perspectives, such as the fact that it is a part that has been filled in, and the fact that it was not mentioned in domestic literature at the time the material was researched, indicating that it had not yet been published in Japan.
3 Copyright Infringement
Recently, we have received a number of infringing videos (hereinafter referred to as "infringing videos") that are being distributed without any indication of the source of the expression that can be identified as having been published by Susanna's Hobbies® in terms of the form of expression or translated portions. The following are some of the infringing videos that have been distributed. Of these videos, all videos that can be identified as having been published by Susanna's Hobbies® in terms of the form of expression or translation, at least chronologically, with transmission starting later than the time of distribution of the Susanna's Hobbies® videos, have been identified as infringing videos. We believe that this is an infringement of Susanna's Hobbies® copyright.
Therefore, Susanna's Hobbies® has notified the distributors of the infringing videos that they are infringing the copyright of Susanna's Hobbies® and have therefore notified YouTube of the infringement.
4 Scope of License
Laws of natural science, discoveries thereof, and inventions, etc., which are creations of technical ideas utilizing such laws (hereinafter referred to as "Laws, etc.") The laws of natural science, their discoveries, and inventions, etc., which are creations of technical ideas utilizing such laws ("Laws, etc."), are truths common to all people and should be freely used by anyone, except when they are the subject of patent rights or other rights.
Susanna's Hobbies® has again asked its patent attorneys and lawyers about the relationship between crochet and knitting and copyright law, and has confirmed the scope of permission that may be requested.
Susanna's Hobbies® has come to the conclusion that we want the above laws, etc., to be freely available to all crocheters and knitters. In this regard, we would like to revise the scope of the permission we have been requesting as follows. Susanna's Hobbies® is not claiming copyright infringement in the form of expression or translation, but rather in the crochet and knitting knots and knitting methods.
Susanna's Hobbies® works and publications in general are subject to copyright, so please continue to apply for permission to use them as you have in the past.
Forms of expression (methods of explanation) of Susanna's Hobbies®: In videos and publications, please cite Susanna's Hobbies® as the source of the material, as an indication of its origin.
Crochet and knitting patterns and knitting techniques published by Susanna's Hobbies® only: Not subject to license. However, if you use a video or publication that mimics Susanna's Hobbies® crochet and knitting stitches or knitting instructions, you must cite Susanna's Hobbies® as the source.
If Susanna's Hobbies® has a patent or other intellectual property right in crochet or knitting, please apply for a license to use such patents or other intellectual property rights.
In addition, Susanna's Hobbies® has recently reported on YouTube some videos in which Susanna's Hobbies® claims to own the copyright to a crochet method of knitting, and requests permission to sell products made using this method of knitting for commercial use. We believe that this is an attempt to unfairly monopolize and profit from the crochet and knitting techniques that should be freely available for use. We believe that this situation is still a situation in which unauthorized use of Susanna's Hobbies® videos and publications is hard to overlook.
5. Future
Susanna's Hobbies® plans to notify the distributors of the infringing videos of the injunction through its agent in due course, but we would like to take this opportunity to request that they voluntarily stop distributing the infringing videos.
We also request that you clarify that there are no copyrights claimed in the infringing videos and that you cease to gain unjust profits from the infringing videos.
If the infringing videos continue to use the expressions in the translated portions and explanatory portions of the videos for which Susanna's Hobbies® holds the copyright, we request that you clarify the quoted portions, clearly credit Susanna's Hobbies® as the source, and use legitimate methods of quotation. We request that you do the same.

Q2： Susanna's Hobbies®が紹介した編み目を用いた編み方動画を作りたい、編み方をブログなどで説明したい、編み物教室でカリキュラムとして教えたい場合はどうしたらいいですか？
A：編み方、編んでいるシーンの動画、写真、説明、編み物教室でのレッスンなどは著作権侵害に当たるので、その場合は必ず引用クレジットとして、引用部分を明確にし、Susanna's Hobbies®の名称を表記してください。
編み目を用いて編んだ自作デザインの作品を紹介するだけの動画は著作権侵害には当たりませんが、編み方などを口頭または筆記など表記を問わず、表現説明する場合は全て、引用元を上記の方法で記載してください。また、表記を怠ったとしてSusanna's Hobbies®から著作権侵害として削除依頼が届いた場合は速やかに対象物を削除するか引用を記載してください。引用表記が確認でき次第、侵害の申し立ては取り下げます。
編み物教室でカリキュラムとしてご利用になりたい場合は事前に利用許諾をお申し込みください。講座は実演及び口頭説明のみとし、テキスト配布、編み図作成などを含む表記説明全般、録画および録音は一切禁止致します。また、カリキュラムとして生徒を募集される際には、写真は教室で編んだ現物写真を利用し、必ずSusanna's Hobbies®の引用であることとSusanna's Hobbies®が使用している作品名称を記載し、告知配布するようにお願いいたします。契約違反が見受けられた場合は、以降の利用をお断りする場合がございます。

A：利用に際しては個別に契約を申し込んでください。無断使用は著作権侵害ではなく、知的財産権の侵害となります。営利、非営利を問わず利用自体が権利の侵害とみなされます。通常企業が特許権を取得するのはその技術を市場で一定期間独占する権利を得るためです。ですから、契約を申し込んでも権利者の意向次第では利用が断られる場合があることを予め知っておいてください。

Q６：海外のフリーパターンや動画を翻訳したSusanna's Hobbies®の動画や文章説明を見て作品を編んだのですが販売しても良いですか？
A：Susanna's Hobbies®に販売権はありません。海外のフリーパターンや動画は、パターン提供者とオリジナル作家に著作権が帰属します。Susanna's Hobbies®はパターン提供者の損失が発生しない範囲で動画を作製しています。翻訳後、独自解釈した編み方を独自表現で説明することによる著作権を有しております。個人でお楽しみください。家族に編む、などは構いませんが、無断で対価を得ることは禁止されています。どうしても販売したい場合は個別に利用許諾を申し込む必要があります。Susanna's Hobbies®では利用許諾申し込み代行は請け負っておりません。

Q7：海外動画でSusanna's Hobbies®の動画を模倣しているものや海外でSusanna's Hobbies®の作品が模倣されて販売されているのを見かけましたが著作権侵害ではありませんか？
A：編み方を違う言語で説明している場合には上記の通り翻訳権が認められます。しかし、作品や表現に模倣性があり、それを無断で販売することはパリ条約やベルヌ条約（またそれに基づいた無方式主義）において日本国内と同様に著作権侵害が認められます。なお、加盟していない国においては著作権侵害で訴えることはできません。
